Advertising Associate - 3rd to 5th year

Location: New York or Washington DC

Davis Wright Tremaine LLP has an exciting opportunity for a mid-level associate to join its nationally recognized advertising practice focusing on contest work before the National Advertising Division and government agencies as well as regulatory counseling on a range of consumer products and services.

What You'll Do:

  • Represent clients at the intersection of consumer protection and advertising law, including matters before the NAD, FTC, FDA, State AGs, and CPSC.

  • Advise clients on claims substantiation, including development and review of underlying consumer research, design and review of claims' test procedures for monadic and comparative product/service claims, and general regulatory compliance oversight and guidance.
  • Support product launches and advertising campaigns, including assisting with product testing, label review, influencer campaigns, and post-market quality issues such as recalls and product withdrawals.
  • Collaborate with advertising agencies, media and telecommunications clients, and consumer electronics, FDA-regulated OTC, banking and consumer product companies to provide comprehensive legal support for advertising, marketing, and promotions programs.

  • Collaborate closely with partners and clients, receiving real responsibility early in your career.
  • Support clients in developing social media and digital advertising initiatives and strategies, including compliance with relevant FTC guidance and practice.

  • Strong Foundation: Subject matter expertise relative to advertising law and, specifically, contested matters as well as current FTC guidance, a general knowledge of NAD precedent, and understanding of the intersection of advertising law and intersecting regulatory standards, e.g., FDA labeling rules.
  • Excellence in Execution: Efficient at research and in written advocacy; practical and business-friendly in counseling and highly responsive.

  • Juris Doctor (JD) degree from an accredited law school.
  • Active member in good standing of the state bar where you are applying to work.

The annualized salary range for this position is $225,000 to $290,000. Actual pay will be adjusted based on the candidate's education, training, experience and other job-related factors permitted by law. Full time employees may be eligible for a bonus and health insurance with an optional HSA, long term disability, dental insurance, vision care, life insurance, Healthcare and Dependent Care Flexible Spending Accounts, 401(k), vacation, sick time, 10 paid holidays each year and an employee assistance program. For full-time employees, the initial sick leave benefit is 80 hours of sick leave per year. Attorneys generally take approximately three weeks of vacation from work each year, and it may vary depending on the needs of the clients and the firm. Additional voluntary benefits programs include: voluntary accident insurance, voluntary life, voluntary disability, voluntary long-term care, and pet insurance. Commuter and Transit programs are also available.
